1. Acceptance of Terms
By accessing and using Swapia, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our service.
2. Description of Service
Swapia is a marketplace platform that connects buyers and sellers for person-to-person transactions. Users may browse public listings and search the marketplace without logging in, but certain features require an account. We facilitate listings and communications but are not a party to any transactions between users.
3. User Accounts
Some features, including creating and managing listings in My Items, saving favorites, contacting sellers through messaging, and managing your profile, require an account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
4. User Conduct
You agree not to:
- Post false, misleading, or fraudulent listings
- Sell illegal items or items you do not have the right to sell
- Harass, abuse, or harm other users
- Use the service for any unlawful purpose
- Attempt to gain unauthorized access to any portion of the service
5. Prohibited Items
The following prohibited item categories are currently enforced on Swapia:
- • Gambling/lottery - Lottery tickets, casino equipment, and gambling devices
- • Other Weapons - Knives, swords, and other weapons not covered elsewhere
- • Tobacco/Alcohol - Tobacco and alcohol products (where prohibited by law)
- • Adult Content - Pornography, sexual services, and escort services
- • Ammunition - Bullets, shells, cartridges, and reloading supplies
- • Counterfeit Goods - Fake brands, knockoffs, and pirated products
- • Explosives/Hazardous Materials - Explosives, fireworks, and hazardous materials
- • Fraud/Scams - Scams, phishing tools, and fraud-related items
- • Government Documents - Government IDs, licenses, or permits
- • Hazardous Materials - Toxic, radioactive, or otherwise hazardous materials
- • Identity/Documents - Personal information or identity documents
- • Illegal Drugs - Illegal drugs, controlled substances, and drug paraphernalia
- • Prescription Medications - Prescription medications and medical devices
- • Protected Wildlife Products - Endangered or protected animals and plants, ivory and other regulated animal products
- • Stolen Property - Any stolen items or items with removed serial numbers
- • Weapons/Firearms - All guns, rifles, pistols, and firearm parts
Additional items may also be prohibited where required by applicable law or platform safety rules.
6. Transactions
All transactions are conducted directly between buyers and sellers. Swapia is not a party to any transaction and does not handle payments or guarantee the quality, safety, legality, accuracy, or availability of items listed.
You are solely responsible for:
- Inspecting items before purchase
- Arranging payment and delivery
- Resolving disputes with other users
7. Listing Limits
We impose limits on the number of active listings per user to ensure platform quality and prevent abuse. Limits may vary by account type and may also be adjusted by platform administrators.
8. Account Inactivity
To maintain a fresh and relevant marketplace, we may remove listings from accounts that have been inactive for an extended period.
- Listings may be removed if you have not logged into your account for 24 months or more
- Your account itself will not be deleted and you can log back in at any time
- You may re-post items after logging back in, subject to current listing limits
We recommend logging in periodically to keep your listings active.
9. Privacy
Your use of Swapia is also governed by our Privacy Policy. Please review our privacy policy to understand how we collect and use your information.
10. Intellectual Property
All content on Swapia, including text, graphics, logos, and software, is the property of Swapia or its content suppliers and is protected by intellectual property laws. You retain ownership of content you submit to the platform.
11. Disclaimer of Warranties
Swapia is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Swapia shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.
13. Indemnification
You agree to indemnify and hold harmless Swapia and its affiliates from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on this page. Your continued use of the service after such changes constitutes acceptance of the new terms.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Swapia operates, without regard to its conflict of law provisions.
